Terms & Conditions
These terms set out the rules for using the website and explain the general relationship between website information, enquiries, membership and organised club activities.
1. Acceptance and scope
These Terms & Conditions govern use of the Ivorquellavessia website and the general process for club enquiries, membership information, training information and competition information. By using the website, you agree to use it lawfully and in a way that does not interfere with other users or the operation of the site.
Specific membership, training or event arrangements may include additional information supplied before participation. If a specific written arrangement conflicts with these website terms, the more specific arrangement applies to that activity to the extent of the conflict.
2. Club entity and contact
The website is operated for Ivorquellavessia Surf Club Limited, with the address 23 Maunganui Road, Mount Maunganui, Tauranga 3116, New Zealand. General contact information is provided on the Contact page.
3. Permitted website use
You may browse the website, read club information and submit genuine enquiries for personal or organisational purposes connected with the club. You must not attempt to damage, overload, bypass security, introduce harmful code, collect information through abusive automated means, impersonate another person, or use the site for unlawful or misleading activity.
We may restrict access to the website or particular functions when reasonably necessary for maintenance, security, legal compliance or protection of the service.
4. Website information
We aim to keep training, membership, competition and contact information accurate and useful. Surf conditions, schedules, programme capacity, event formats, eligibility requirements and fees can change. Website content is therefore general information unless expressly confirmed for a specific booking, membership or event.
Before relying on a date, division, session time or event requirement, confirm the current details provided for that activity.
5. Enquiry form
The website enquiry form records the information entered and displays a confirmation message. Submitting the form is a request for contact; it does not by itself create a membership, reserve a place, register a competition entry or form a binding service agreement.
You are responsible for providing accurate contact information so the club can respond. Do not submit information unrelated to the purpose of the enquiry.
6. Membership
Membership is subject to the club’s acceptance process, current capacity, payment of applicable fees and compliance with club rules communicated to members. Membership benefits may include eligibility for specified training, club sessions, competitions and member communications, but availability depends on scheduling, conditions, division criteria and programme capacity.
Membership is personal unless the club expressly agrees otherwise. Members must not misrepresent their eligibility, transfer access to another person or misuse club systems or event processes.
7. Fees and payment information
Any fee displayed on the website is stated in New Zealand dollars unless indicated otherwise. The annual membership amount shown on the Membership page is general current information and may be updated for future membership periods. Specialist sessions or event entries may have separate fees, which will be disclosed before a member commits to the relevant activity.
If a payment arrangement is required, the applicable process, due date and cancellation terms should be confirmed in the specific membership or event communication.
8. Surf activities and participant responsibility
Surfing takes place in a changing natural environment. Conditions, crowd movement, currents, wave size, seabed shape and weather can change quickly. Participants are responsible for acting within their own ability, following reasonable club instructions, using suitable equipment and making sensible decisions when conditions are beyond their current capability.
Coaching and club organisation can support better decisions but cannot remove the inherent uncertainty of ocean activity. Participants must communicate relevant practical limitations that affect their ability to follow session instructions or safely take part in the scheduled activity.
9. Changes caused by conditions
The club may move, delay, shorten, restructure or cancel a session or competition when conditions, staffing, safety considerations, access restrictions or operational circumstances make the planned activity unsuitable. A change made for those reasons is intended to protect the quality and organisation of the programme rather than guarantee a particular type of wave or event format.
10. Competition entries and conduct
Competition entries are subject to division rules, entry limits, check-in requirements and the event briefing. Competitors must follow priority procedures, judging and event-management instructions communicated for the event.
Results reflect the judging framework used for that event. Questions about scoring or procedure should be raised through the process announced by the competition team rather than by disrupting a heat or other competitors.
11. Club conduct
Members, competitors and visitors are expected to communicate respectfully, avoid harassment or intimidation, follow reasonable instructions in organised club activities and respect other water users. The club may remove a person from an activity or restrict future participation where conduct seriously disrupts the event, threatens safety, abuses staff or participants, or repeatedly ignores communicated rules.
12. Intellectual property
The website’s original written content, branding, layout, graphics and other club-created material are protected by applicable intellectual property law. You may view and print reasonable extracts for personal use. You may not reproduce substantial parts of the website for commercial publication, remove ownership notices or present club content as your own without permission.
References to surfing methods, judging concepts and general coastal knowledge do not claim ownership over ideas that are public, functional or otherwise not protected by intellectual property rights.
13. Information you submit
You retain ownership of text and material you provide through an enquiry or club process. You give the club permission to use that material as reasonably necessary to answer the enquiry, administer membership, organise the requested activity, maintain records or meet legal obligations.
Do not submit material that you do not have the right to provide, that is unlawful, or that contains unnecessary information about another person.
14. Privacy
Handling of personal information is described in the Privacy Policy. The Cookie Policy separately explains browser storage and the current website’s approach to cookies.
15. Website availability
We aim to keep the website available but do not guarantee uninterrupted access. Maintenance, security work, hosting problems, connectivity failures or events outside reasonable control may temporarily affect availability. We may update, replace or remove website features where reasonably necessary.
16. External links
The current front-end is designed to operate without externally loaded dependencies. If a future version contains a link to a separate website, that link is provided for convenience and does not automatically mean the club controls or endorses the separate service.
17. Liability and non-excludable rights
Nothing in these terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under applicable New Zealand law or other law that applies to you. Subject to those non-excludable rights, the club is not responsible for losses caused solely by information you supplied incorrectly, actions taken outside club instructions, independent decisions unrelated to an organised activity, or events outside the club’s reasonable control.
Any limitation must be interpreted only to the extent permitted by law. These terms are not intended to remove legal protections that apply to consumers or participants where those protections cannot be contracted out of.
18. Restriction or termination of access
Website access or club participation may be restricted where reasonably necessary because of serious rule breaches, non-payment of applicable fees, misuse of systems, unlawful conduct, repeated disruption, or other substantial failure to comply with agreed participation requirements. Where practical, the club will communicate the reason and any next step available.
19. Governing law
These website terms are governed by the laws of New Zealand, subject to any mandatory rights that apply under another jurisdiction and cannot lawfully be excluded. Courts or tribunals with lawful jurisdiction may hear disputes as provided by applicable law.
20. Changes to these terms
We may update these terms when the website, club structure, competition programme or applicable requirements change. The current version will be published on this page with its effective date. A material change affecting an existing membership arrangement will be handled consistently with the specific membership terms and applicable law.
